Members received an application for Planning Permission – Change of use of land for recreational use as a cycle park, construction of associated cycle tracks/trails, erection of a building to be used as a visitor centre, provision of associated car parking and construction of a vehicular access at land off Donington Road, South Willingham.

 

The application had been subject to significant levels of interest and representation and had been subject to a call-in request by Cllr Fry such that it was considered appropriate for Committee consideration.

 

The main planning issues in this case were considered to be:

 

·   Principle of the Development in this location

·   Impact of the Development on the Character of the Area and the setting of the AONB

·   Highway Safety and Capacity

·   Impact on Heritage Assets

·   Impact on Ecology

·   Impact on the Woodland

·   Impact on the Amenity of the Residents of the Area

Members were referred to the information contained within the supplementary agenda, pages 1 to 5, which had been circulated the previous day.

 

 

The Development Management Lead Officerdetailed the site and surroundings information to Members at Paragraph 2, together with the description of the proposal at Paragraph 3, pages 21 to 23 of the report refer. 

 

Christopher Heneage spoke in support of the application.

 

Rosanna Hart spoke in objection to the application.

 

Shirley Asquith spoke on behalf of the Parish Council.

 

Councillor Richard Fry spoke as Ward Member.

 

Members were invited to put their questions forward to the speakers. 

 

  • A Member queried whether the proposed cycle track/trail would be linked in any way with the Lindsey Trail.  The Applicant advised that he was aware of conversations taking place with Sustrans to try and make it an approved cycle route.  As the local residents had already noted, the road was already suitable for local cyclists so it could be argued that it was already on a national cycle route, however currently it was not recognised as such by Sustrans.

 

  • A Member queried whether the Applicant had considered any other alternatives, for example, a solar farm.  The Applicant advised that they were always looking at good ways to diversify and that this fitted in with the ethos of the estate as it was low impact, it was green space and it promoted healthy living.  He advised that solar farms had a place but was not something that they would have considered, particularly in a designated Area of Outstanding Natural Beauty (AONB).

Members received an application for Planning Permission – Erection of 198no. dwellings with associated garages and construction of a vehicular and pedestrian access at Land at Ludborough Road, North Thoresby, Grimsby, Lincolnshire, DN36 5RF.

 

The application was initially reported to the Planning Committee on 7th July 2022. A copy of that report is attached as Appendix 1. The Planning Committee deferred the application for the following reason:

 

"That the application be deferred to allow for further negotiation to bring some clarity to the footpath link to the centre of the village as the current form of development appeared to lead to an isolated form of development."

 

Full details are contained within Paragraph 1 of the report, pages 63 to 64 of the Agenda refer.

 

The Development Management Lead Officer advised that there were supplementary papers with additional representations raising a variety of issues and concerns which were outlined in the paper.

 

The main planning issues in this case were considered to be:

 

  • Affordable housing
  • Sport England’s relationship with the cricket facility
  • Connectivity to the village

 

Members were referred to the information contained within the Supplementary Agenda, pages 6 to 10 refer which had been circulated the previous day.

  • A Member queried with Mrs Howard whether a one way system was part of the traffic plan. Mrs Howard responded that there was a 40 metre stretch of road which would become single lane. 

 

  • A Member raised a concern to Mr Ibbotson with regards to the two footpaths to the north of the site and whether they would be built as part of the development. Mr Ibbotson confirmed that the footpaths were on the plan going to the boundaries of the site but, for the link to the High Street there would be reliance on planning conditions for any new development proposal on the adjacent land. The footpath to the school would be built if the school decided they wanted it.

This application had received significant objection from the local community and from the Parish Council.  The recommendation was for conditional approval and therefore under those circumstances it was considered appropriate for determination by the Planning Committee.

 

Members were referred to the supplementary papers, page 10 refers.

 

The Development Management Lead Officer detailed the site and surroundings information to Members at paragraph 2, together with the description of the proposal at Paragraph 3, pages 107 to 108 of the report refer.

 

Bella King spoke in support of the application.

At this point in the Meeting, Councillors Eyre and Matthews asked it be noted that they knew David Whitehouse, however following seeking advice from the Legal Advisor remained in the meeting.

 

The Chairman read out a submission from Councillor Harrison as Ward Member.

·       A Member queried whether the hedges and trees would be retained. Bella King confirmed that the Wildlife Report included a landscape strategy and would retain all hedges as they currently stood and had made recommendations on the maintenance of the landscape. She confirmed that there was also a recommendation to keep a 15m spread from the roots for the mature trees which would help to retain all of the wildlife and would also screen the caravans from three sides.

 

·       A Member queried whether the sewerage would go into the mains.  Bella King advised that it was originally going to go into the Anglian Water sewer, however, Lindsey Marsh Drainage Board had advised that they would take all of the foul sewerage and some of the surface water sewerage into their drain at the back. This would result in having biotech systems and sewerage treatment plans on site.

The application was put before the Members as the proposal was considered to be a departure from the Council’s Local Plan and the recommendation was for approval.

 

The Development Management Lead Officer detailed the site and surroundings information to Members at Paragraph 2, together with the description of the proposal at Paragraph 3, page 131 of the report refer.

 

There were no speakers on the application.

 

Following which, the application was opened for debate.  No comments or questions were received.

 

The application was proposed and seconded for approval.

 

Upon being put to the vote, the proposal for approval in line with officer’s recommendation, subject to conditions, was carried.

 

Vote:           10 in favour,         0 against,             1 abstention

 

RESOLVED:

 

That full planning permission be approved, subject to the following conditions:

 

1)   The development hereby permitted must be begun not later than the expiration of four years beginning with the date of this permission.

 

Reason: To take account of the present restrictions on implementing permissions, in order to assist the recovery and in order to comply with the requirements of Section 51 of the Planning and Compulsory Purchase Act 2004.

 

2)   The development hereby permitted shall only be undertaken in accordance with the following approved plan numbers:
