To seek confirmation whether a temporary Tree Preservation Order made to protect one Birch tree in the grounds of the Black Horse Inn, Moat Lane, Old Bolingbroke be made permanent.

Minutes:

Members received a report from Colin Horton, Arboricultural Officer which enabled them to consider whether a temporary Tree Preservation Order (TPO) made to protect one Birch tree in the grounds of the Black Horse Inn, Moat Lane, Old Bolingbroke be made permanent.

 

The Arboricultural Officer referred Members of the Committee to the presentation which displayed images of the tree which was based in a small raised bed made of brick and surrounded by a patio with stones. 

 

The Aboricultural Officer recommended to Committee that the TPO should be made permanent.

 

Following which, debate ensued.

 

  • A Member disagreed with the officer’s recommendation, outlining the tree as a health and safety hazard and stating that it should be removed.

 

It was proposed that the TPO should not be confirmed.

 

A Member seconded the proposal.

 

  • A Member enquired as to the age of the tree and was advised that it was approximately 30 years old.

 

A Member then proposed, following officer recommendation, that the TPO be confirmed.

 

A Member seconded the proposal.

 

The Legal Representative advised Members that having a TPO did not mean you could never remove a tree, but that there were tighter controls on the maintenance of the tree.

 

The Arboricultural Officer pointed out that during the Council’s assessment of the tree the score was high at 9/10 and concurred with the legal representative’s advice.

 

  • A Member queried whether it was within the Council’s gift to advise people whether to remove a tree on their own land.  The Legal Representative advised Members that the Council had to adhere to legislation.

 

  • A Member commented that the tree was too big for its surroundings.

 

  • A Member further commented that with a TPO in place, the tree would be able to be trimmed back.

 

Upon being put to the vote in line with the officer recommendation that the TPO be confirmed (made permanent), Members voted as follows:

 

Vote:           5 in favour,          2 against,            2 abstentions

 

RESOLVED:

 

That the Old Bolingbroke 2022 (105.33) Tree Preservation Order be confirmed without modification.

Members received an application for Planning Permission - Change of use of land for the siting of 6no. static caravans, erection of a holiday cottage, excavation of land to form a wildlife pond, alterations to the existing access and construction of internal access roads at Mill Farm House, Sea Lane, Hogsthorpe, Skegness, PE24 5QG.

 

The planning application was for consideration by the Planning Committee due to the significant number of local objections (496) to the proposed development and at the request of the Ward Member, Councillor Williams.

 

The main planning issues were considered to be:

 

  • The principle of the development in this location and flood risk and drainage.
  • Impact of the proposed development on the character of the area.

 

  • Impact on the amenity of the neighbours.

 

  • Other Issues - Impact on Highway Safety and Capacity; Ecology & Protected Species; Archaeology; Public Right of Way; and Contamination.

 

Members were referred to the additional information contained within the Supplementary Agenda, page 1 refers.

 

Lindsey Stuart, Principal Planning Officer detailed the site and surroundings information to Members at Paragraph 2, together with the description of the proposal at Paragraph 3, pages 13 to 14 of the report refer.

 

The Principal Planning Officer asked it be noted that there were typos in Conditions 6, 7 and 11 and Condition 16 was omitted from the report which related to the widening of the access, pages 26 to 27 of the Agenda refer.

 

Mr Andrew Clover & Mr Neil Balderston spoke in support of the application.

 

Ms Jill Proud spoke in objection to the application.

 

Mr Graham Matthews spoke on behalf of Hogsthorpe Parish Council.

 

Councillor Graham Williams spoke as Ward Member.

 

Members were invited to put their questions to the speakers.

 

  • A Member queried with Councillor Williams the location of the nearest objector.  Councillor Williams confirmed that the closest objector lived next door and other houses were also close to the proposed site.

 

  • A Member commented that the site would bring economy and tourism to the area which was positive and wondered whether the objectors were being over-sensitive because the proposed site was so close to their properties.  Councillor Williams declined to comment on this, however he pointed out that the site would be centric to Hogsthorpe and Chapel St Leonards and should it expand further in the future, it would encircle Chapel St Leonards with caravans.

Members received an application for Planning Permission - Erection of a bungalow with integral garage and construction of a vehicular access at High Grange Farm, Occupation Road, Fulstow, Louth, LN11 0XF

 

This application was presented to the Planning Committee for consideration in the interest of transparency, due to the applicant’s son being an employee of the Council and working within the Planning Department.

 

The main planning issues were considered to be:

 

  • Principal of development in this location.
  • Impact on the character of the area and on residential amenity.
  • Archaeology.
  • Highway safety.

 

Michelle Walker, Deputy Development Manager, detailed the site and surroundings information to Members at Paragraph 2, together with the description of the proposal at Paragraph 3, page 33 of the report refers.

 

Mr Andrew Clover spoke in support of the application.

 

Councillor Edward Mossop spoke as Ward Member.

 

Members were invited to put their questions to the speakers.

 

  • A Member queried whether there had been any known local archaeology in the past on that site.  Councillor Mossop advised that Mr Hallett would be respectful of any archaeology and that he was not aware of anything on that site.

 

N.B. Cllr Mossop left the room at 11:09am.

 

The Deputy Development Manager referred Members to the three conditions relating to archaeology, pages 38 to 39 of the Agenda refer, and explained some of this in detail.

 

Following which, the application was opened for debate.

 

A further discussion ensued with regards to archaeological work on the site and the Deputy Development Manager confirmed that whilst there was no known archaeology information relating to the site, the site lay in an area that was of archaeological interest.

 

Following which, the application was proposed and seconded for approval.

 

Upon being put to the vote, in line with the officer recommendation for approval, Members voted as follows:

 

Vote:           8 in favour,           0  against,            1 abstention 

 

RESOLVED:

 

That full planning permission be approved, subject to the following conditions:

 

1.      The development hereby permitted must be begun not later than the expiration of three years beginning with the date of this permission.

 

Reason: In order to comply with the requirements of Section 51 of the Planning and Compulsory Purchase Act 2004.

 

2.      The development hereby permitted shall only be undertaken in accordance with the following approved plans;
